RECOMMENDED that,
 
The lease of City land being portions of Erf 3400 Simon’s Town situated at Seaforth Road, Simon’s Town, shown hatched and lettered ABCDEFGHJ and KLMN on the attached plan LT 751v2 marked Annexure A, in extent approximately 500 and 20 m² respectively, to The Girl Guides Association of South Africa (NPO-004-265), 4 Seaforth Road, Simon’s Town, be approved subject to inter alia the following conditions, that:
 

  1. A tariff rental of R1 039,13 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
 
  1. The lease will endure for a period of 10 years, with an option to renew for a further 10 years, subject at any time to TWO MONTHS’ notice of termination;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The property be used for Brownies, Girl Guiding and storage purposes only. No fencing other than non-permanent visually permeable boundary fencing will be permitted within the lease perimeter. Any non-permanent structures are to be submitted to the lessor for approval prior to construction;
 
  1. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation be payable for any improvement made to the property;
 
  1. Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, be carried out at the applicant’s cost;
 
  1. No new building or structure is permitted. No change of an existing use or alteration of the external structure of an existing building or structure, is permitted;
 
  1. Should the lease be cancelled or required for road or stormwater purposes, the leased area may be required to be reinstated to the original natural state, to the satisfaction of Transport: Asset Management & Maintenance Department;
 
  1. Pedestrian traffic must not be affected;
 
  • No permanent structures are permitted in the road reserve;
 
  1. Since important Telkom cables are affected, a Telkom representative must be contacted at least 48 hours prior to commencement of any construction work;
 
  • It remains the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which may not be indicated on the plan;
 
  • Telkom requires access to carry out maintenance or upgrade existing plants at all times;
 
  1. The applicant be held responsible for any cost involved in the deviation or removal of any existing Telkom plant.
