RESOLVED to RECOMMEND that the lease of City Land, being a portion of Erf 148 Clifton ,situated off Clifton Road, Clifton, shown hatched and lettered ABCD on the attached plan 130009085 marked annexure A, in extent approximately ± 105 m² to Rony Vogel or his successors in title, BE DEFERRED for the following reasons:

Is the tariff appropriate – it is way too low, given high property values in the area?

Was any notices issued in terms of illegal encroachment in this regard?

What preventative measures for encroachment can be used?

16SUB 13/02/2023: RESOLVED that the lease of City Land, being a portion of Erf 148 Clifton , situated off Clifton Road, Clifton, shown hatched and lettered ABCD on the attached plan 130009085 marked annexure A, in extent approximately ± 105 m² to Rony Vogel or his successors in title,
BE REFUSED for the following reasons
a) Issues with encroachment-boundary walls not compliant with the laws.
b) The wall must be demolished, as there is no permission to build in that space.
c) Subcouncil will not regularize encroachment.
