RESOLVED to RECOMMEND that:
-
In terms of the provisions of Regulations 34 (b) of the Municipal Asset- Transfer Regulations (R.878) promulgated on 22/08/2008, the right to use, control or manage by way of a public competitive process, the vacant retail space at the MyCiti Bus Facility situated on portion of Remainder Erf 5188 RE, 5 Century Way, Century City, Milnerton, measuring 43m² in extent, zoned General Business 3, BE GRANTED principle, subject to conditions to be imposed by the Director: Property Management in the exercising his / her delegated authority, which will include inter alia the following conditions:
i) a market related rental will be charged
ii) the lease will endure for a period not exceeding 5 years;
iii) the market-related rental will be subject to 6% escalation rate;
iv) the lease will be subject to compliance with any applicable statutory
requirement
v) any statutory approvals required to enable the proposed use of the
property will be the responsibility of the lessee;
vi) any municipal services on site be protected at all times;
vii) any alterations to any municipal services necessary as a consequence
of the proposal or requested by the applicant will be carried out at the
lessee’s cost; and
viii) any improvements or upgrades to the site requested by the lessee to
fulfil its purpose will be carried out at the lessee’s cost
