RESOLVED TO RECOMMEND
Subcouncil 20 supports the lease of City land, being a portion of Erf 3362 Contantia situated at Colyn Road, Constantia, shown hatched and lettered ABCDEFGHJKL middle of river M on the attached plan LT152v2 marked annexure A, in extent approximately 2.65 hectares, to Vivienne Elley or her successors in title, be approved subject to inter alia the following conditions, that:

A market rental of R4 500.00 per month exclusive of rates and VAT calculated at the rate applicable at the time of transaction be payable;

Beneficial occupation of R1 500.00 per month, escalating at 8% per annum as from 2015-09-01 until 2018-11-31;

The monthly rental of R4 500.00 per month shall escalate at 8% per annum effective and payable as from 2018-12-01 until 2020-03-31 and then 6% per annum thereafter;
-
The lease will endure for a period of 10 (ten) years and is to be reviewed after a period of 5 (five) years;
-
No improvements i.e. stables, structures etc. to be erected on the subject property;
-
The property be used for keeping and grazing of horses and gardening purposes only;
-
Subject to such further conditions to be imposed by the Director: Property Management in terms of his/her delegated authority;
-
Subject to compliance with any other statutory requirements.
