                RECOMMENDED that,
 
the lease of portion of public street, being portions of Erven 693 and 824 Simon’s Town situated at 23 Barnard Street, Simon’s Town shown hatched and lettered ABCDEFGHJKLMNPQR on the attached Plan LT 1544v0 marked annexure A, in extent approximately 190 m², to Strawberry Hill Trust, or its successors in title, be approved subject to inter alia the following conditions, that:
	- 
		A market rental of R500 per month inclusive of rates and exclusive of VAT calculated at the rate applicable at the time of transaction be payable;
 
	- 
		The above rental shall escalate at 8% per annum for the period 2017-08-01 until 2020-03-31; thereafter it will further escalate at 6 % per annum;
 
	- 
		Occupational rental: A rental of R500 (inclusive of rates and exclusive of VAT) per month shall be payable as from 2017-08-01, escalating at 8 % per annum, until 2020-03-31. The escalated rental will thereafter escalate at 6 % per annum until date the lease contract has been signed by Council;
 
	- 
		The lease will endure for a period of 10 years, the rental to be reviewed after 5 years;
 
	- 
		The property be used for regularising existing encroachment building and gardening purposes;
 
	- 
		Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
	- 
		Subject to compliance with any other statutory requirements;
 
	- 
		No compensation will be payable for any improvement made to the property
