It is recommended that:
 
Council grants in principle approval of the lease of portions of Remainder Erf 38295 and Erf 38296 Milnerton, situated at Potsdam Road, Killarney Gardens, Milnerton, in total extent approximately 513 130m² as shown lettered ABCDEFGHJKL on the sketch attached as Annexure A, to Western Province Motor Club (t/a Killarney International Raceway) or its successors in title, in terms of Regulation 34(1)(b) and that
 
Council approves the lease of portions of Remainder Erf 38295 and Erf 38296 Milnerton, situated at Potsdam Road, Killarney Gardens, Milnerton, in total extent approximately 513 130m² as shown lettered ABCDEFGHJKL on the sketch attached as Annexure A, to Western Province Motor Club (t/a Killarney International Raceway) or its successors in title, subject to inter alia the following conditions, that:
 
  1. A below market related rental of R68 600 per month exclusive of rates and VAT calculated at the rate applicable at the time of transaction be payable;
 
  1. The monthly rental shall escalate at 8% per annum commencing from date of expiry of the existing lease agreement, i.e. as from 2023-01-01;
 
  1. The lease will endure for a period of 15 years, subject to a rental review after 5 years;
 
  1. The property be used for a motor vehicle race track, sport and recreational purposes only;
 
  1. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvements made to the property;
 
h)       The objections submitted by the Environmental and Heritage Management Branch and Water & Sanitation Department not be upheld.
