Resolution detail

That Subcouncil 18 RECOMMENDS that the lease of a portion of City Land, being portions of Erf 80955 Cape Town situated at off Roscommon Road, Heathfield shown hatched and lettered ABCDEFGH & JKLM on  Plan LT1470v1 marked annexure A, in extent approximately 436m² and 70m², to St Augustine Cricket Club (135-164 NPO) or their successors in title, BE APPROVED subject, to inter alia the following conditions, that:
 

  1. A tariff rental of R 995.65 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
 
  1. The lease will endure for a period of 10 years, with an option to renew for a further 10 years, subject at any time to TWO MONTHS notice of termination;
 
  1. The rental will be adjusted annually in terms of the rental tariff  structure as approved by Council;
 
  1. The property be used for sporting purposes only and no structures other than the existing structures will be permitted with the lease area;
 
  1. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the  property;
 
  1. Adherence to the City of Cape Town’s water by-laws;
 
  1. Electricity services exist within the lease area. Any alterations or deviations to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicants cost;
 
  1. Should the lease area be required for future road or storm water purposes and the lease cancelled, the applicant may be required to reinstate the lease area to the original natural state, to the satisfaction of the Urban Mobility;
 
  1. Telkom services are known to exist within the lease area. Telkom wayleave WWIP_WSBR3467_17 attached as Annexure B to be adhered to;
 

l. It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which may not be indicated on the plan;

 
  1. No mechanical plant may be used within 3 meters of any plant (i.e.  telecommunication equipment above or below ground level);
 

n. Any alterations or relocations to Telkom plants necessary as a consequence of the proposal or requested by the applicant, through a written application to Openserve, will be carried out at the applicants cost.
