RESOLVED unanimously by Subcouncil 2, for reasons as set out in the report to recommenderd
 
that the lease of portion of public street, being a portion of the Reminder of Erf 572 Kraaifontein, situated at Hout Street, Peerless Park North, Kraaifontein, shown hatched and lettered ABCD on the plan no TA 104v1 attached and marked Annexure A, in extent approximately 119m2, to Gerhardus Cornelius and Lorinda Engelbrecht, owners of the adjacent Erf 1815 or their successors in title, be approved subject to inner alia the following conditions:
 

  1. A tarrif rental of R 1130.43 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
  2. The lease will endure for a period of 10 years;
  3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
  4. The property be used for garden and security purposes only.
  5. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority.
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvement made to the property;
  8. All outstanding account with the City of Cape Town be settled;
  9. Unrestricted 24 hours vehicular and personnel access to the areas/lanes is to maintained for the purpose of accessing and maintaining electricity services;
  10. Any alterations to electricity services necessary as a consequence of the proposal or requested by the applicant, will be carried out at the applicant’s cost;
  11. The thoughfare may be enclosed on both sides and the erection of the  Electrical Generation and Distribution Department;
  12. No excavation is to take place on site without the possession of a wayleave and works permit;
  13.  The lessee shall be responsible at all time for the maintenance and good order of the land;
  14. The lease may be suspended at any time should the applicant not comply with the conditions;
  15. On termination of the lease, the entire leased area must be reinstated at the Lessee’s expenses.
