It is recommended that the lease of portions of City owned land (a Public Street),being portions of the Remainder of Erven 19081 and 19529 Kraaifontein, bounded by Ntsethe, Ndawo and Mela Streets, Bloekombos, Kraaifontein, shown hatched and lettered ABCDEFGHJ on the attached Plan No TA 1112v1 and marked Annexure A, in extent approximately 910m2, to Bavumeleni Children Centre (034-557 NPO) or its successors in title, be approved subject to inter alia the following conditions:
 

  1. A tariff rental of R999,65 per annum, excluding VAT calculated at the rate applicable at the time of transaction be payble. Rates not applicable;
  2. The lease will endure for a period of ten years;
  3. The rental will be adjusted annually in terms of the rental  tariff structure as approved by Council;
  4. The property may be used for the purposes of a children centre only;
  5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvement made to the property;
  8. Eskom must be allowed 24 hour access to their services traversing the property for maintenance, vegetation management and upgrade purposes;
  9. Eskom must have at least a 10m obstruction free zone around all pylons;
  10. The applicant indemnifies Eskom against any loss, claims or damages pertaining to the interference with Eskom services and apparatus;
  11. Any development which necessitates the relocation of Eskom services will be for the account of the applicant;
  12. Building plans must be submitted for approval in respect of all structures located on the property.
