RESOLVED to RECOMMEND that:
1. Council resolve that, in terms of Regulation 41 (2)(e) of the Local Government: Municipal Asset Transfer Regulations, portions of Public Street, Erven 2394, 376, 2495 and 2496 Oranjezicht situated at Off Upper Orange Street, Oranjezicht, shown hatched and lettered ABCDEFGHJK on the plan 130006189 marked annexure A attached to the report, in extent approximately 1 569m² is surplus to the requirements of the Municipality.
2. the lease of a portion of a public street, Erven 2394, 376, 2495 and 2496 Oranjezicht situated at Off Upper Orange Street, Oranjezicht, shown hatched and lettered ABCDEFGHJK on the sketch 130006189 marked annexure A attached to the report, in extent approximately 1569m², to Government of The Western Cape – Gardens Commercial High School, or their successors in title, BE APPROVED subject, to inter alia the following conditions:

A tariff rental of R1145.00 per annum including VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of 10 (ten) years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for gardening and sporting purposes only;

Subject to such further conditions to be imposed by the Director: Property Management in terms of his/her delegated authority;

Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property.
