RESOLVED
 

  1. It is recommended that, for reasons set out in paragraph 6.1 of the report, the concerns and objections received during the public participation process against the proposed lease not be upheld;
  2. It is recommended that the lease portion of Erf 12414 and portion of Erf 9930-RE, situated at the corner of Wesbank Main Road and Waterblom Street, Wesbank, Blue Downs, shown hatched and lettered ABCDEFGHJKL on the attached sketch ET843 marked annexure A, in extent approximately 25 120 m², to Theodore Hendricks Transport (Sole Proprietor) for sand mining purposes, be approved subject to inter alia the following conditions, that:
 
  1. A market rental of R17 500 per month over the 35-month period is payable;
  2. The lease will endure for a period of 2 years and 11 months only;
  3. The rental is not subject to an annual escalation, but the applicant will be liable for all other municipal costs;
  4. The property be used for commercial purposes (sand mining) only;
  5. Subject to such further condition to be imposed by the Director: Property Management in terms of her delegated authority;
  6. Subject to compliance with any other statutory requirements;
  7. No compensation will be payable for any improvements made to the property
  8. All approvals for mining rights in terms of the Environmental Authorisation of National Environmental Management Act 107 of 1988 (NEMA) must be in place before any mining commences (Department of Mineral Resources (RSA) to give approval);
  9. The applicant will only be allowed to remove approximately 70 000 cubic meters (m3) of sand.
