RESOLVED TO RECOMMEND
 
It is recommended that the lease of portion of public open space, portion of Erf 2950 Durbanville, situated between Agulhas Crescent and Koeberg Way shown hatched and lettered ABCD on the plan no TA 1144v0 attached and marked Annexure A, in extent approximately 179m², to Mr Dennis Edward Morris, owner of Erf 3033 or his successors in title, be approved subject to inter alia the following conditions:
 

  1. A tariff rental of R1 130.43 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
 
  1. The lease will endure for a period of 10 years;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The property be used for garden and security purposes only;
 
  1. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property;
 
  1. All outstanding accounts with the City of Cape Town be settled;
 
  1. Development contributions will be payable, to be quantified by the Reticulation District Head;
 
  1. The applicant/purchaser will be liable for all costs relating to the water and sewer connection points;
 
  1. Should alterations or relocation of existing infrastructure be required, such will be done at the request and cost of the applicant;
 
  • No mechanical plant or vibrator type compactors may be used within three meters of any Openserve plant
 
  1. A written request must be submitted to Openserve for consideration should the applicant require our plant to be relocated. The cost of such relocation will be recoverable from the applicant;
 
  • It is the responsibility of the applicant to verify the existence of the indicated plant and to notify Openserve immediately should the applicant locate any Openserve plant which is not indicated on the plans;
