It is recommended that the lease of a portion of City-owned land, being Erf 13437 Kraaifontein, situated at La Boheme Avenue, Wallacedene, as shown hatched and lettered ABCD on the Plan No TA 692v0 attached and marked Annexure A, in extent approximately 2 366 m², to Masakhane Educare Centre (041-691 NPO), a registered non-profit organization, or its successors-in-title, be approved subject to inter alia the following conditions, that:

A tariff rental of R966,09 per annum, excluding VAT calculated at the rate applicable at the time of transaction, be payable. Rates not applicable;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The lease will endure for a period of ten years;

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirements;
-
The property may only be used for the purpose of an educare centre
and for no other purpose whatsoever;
-
No compensation will be payable for any improvement made to the property;

The tariff rental assumes that the Lessee will be responsible for all maintenance and repairs of the premises;

The Directorate Social Development and Early Childhood Development has no objection to the application, provided that the applicant, as required by law, adheres to the national early childhood development norms and standards, in particular compliance with environmental health, fire and safety and land use management requirements;

The applicant must comply with statutory registration with the
Provincial Department of Social Development;

On termination of the lease, the entire leased area must be restored at the lessee’s expense to a condition acceptable to the City of Cape Town.
