Resolution detail

RECOMMENDED that,

the lease of portions of City land, being portions of erven 1608 and 1817 Simon’s Town situated at Afrikander Road, shown hatched and lettered ABCD

on the attached plan LT 770v3 marked annexure A, in extent approximately 12 m², to Donald Allan James Ross-Watt, owner of Erf 1908 Simon’s Town or his successors in title, be approved subject to inter alia the following conditions:

a) A tariff rental of R 548.70 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

b) The lease will endure for a period of ten years with an option to renew for a futher ten years;

c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

d) The property be used for gardening and security purposes only and no structures other than existing structures will be permitted within the area;

e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

f) Subject to compliance with any other statutory requirements;

g) No compensation will be payable for any improvement made to the property;

h) Electrical services are shown to exist within the lease area and any alterations or deviation to the electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost;

i) The area applied for must remain as is;

j) Electricity infrastructure exists on the property or vicinity. A wayleave shall be obtained from the Electricity Services Department before any excavation work may commence.

k) No Telkom services are known to exist within the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;

l) Telkom requires access to carry out maintenance or upgrade existing plants at all times;

m) If any plant not indicated exists and information or supervision is required contact Telkom at least 48 hours before any work commences;

 

n) A 75mm diameter water is running within close proximity (i.e. ± 2 meters) to the lease area and sewer traverses the subject property (see plan LT 770v3 attached) and no construction, excavation or building works to take place or in close proximity to the existing water services (i.e. 2m);

o) No trees or shrubs with invasive roots are to be planted within close proximity to the existing water infrastructure or sewer;

p) The Council shall have the right of access at all times for the purposes of maintaining and repairing the sewer;
