Resolution detail

 RESOLVED to RECOMMEND that It is recommended that the lease of a portion of a City land, being Erf 8474 Hout Bay situated at Grey Cottage Road, Hout Bay, shown bordered grey and lettered ABCDEF on the Plan LT1522v1 marked annexure A attached to the report, in extent approximately 3279 m², to Peace and Mediation Forum, or its successor in title, BE APPROVED subject, to inter alia the following conditions, that:
 

  1. A tariff rental of R 966.09 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
 
  1. The lease will endure for a period of 10 years.
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The property be used for Community purposes only;
 
  1. Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property;
 
  1. Any boundary fencing is to be of a non-permanent, visually permeable type, the submission and approval of any necessary building plans in terms of the national building regulations if applicable is required;
 
  1. Any fencing that does not require the submission of plans terms of the national building regulations will still require the approval of the Director: Property Management;
 
  1. No Electrical services exist within the vicinity of the lease footprint but any alteration or deviation to the electricity services necessary as a consequence of the proposal, or requested by the Lessee, will be carried out at the applicant’s cost;
 
  1. Electrical Infrastructure may exist on the property and vicinity. A way-leave shall be obtained from the Electricity Generation and Distribution department before any excavation work may commence. In this regard, contact the Electricity Drawing and record Centre Office at 021 763 5650;
 
  • The subject property is affected by an electrical powerline servitude which is to be kept clear;
 
  1. No Telkom services are known to exist within the vicinity of the lease area but it is the responsibility of the Lessee to notify Telkom immediately should the Lessee locate any Telkom plant which might not be indicated on the plan;
 
  • Telkom requires access to carry out maintenance or upgrade existing plants at all times;
 
  • Adherence to the requirement of the City of Cape Town’s water by-laws;
 
  1. No development to take place on the subject property prior to it being approved by Local Authority in terms of the National Building Regulations and Community Fire and Safety by-Law.
 
  1. Emergency and service Vehicle have access to the subject property if and when necessary;
 
 
  1. It is recommended that the objections not be upheld for reasons provided in the report.
