RESOLVED TO RECOMMEND

Subcouncil 20 supports that in terms of Section 14(2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003:

Council resolves that Erf 104331, situated at 5 Cherry Close, Newlands, Cape Town in extent approximately 743m² and zoned Single Residential 1 (SR 1): Conventional Housing on the attached Plan LIS 2218 not be required for the
provision of the minimum level of basic municipal services;

ii. Confirms that the fair market value of the assets described in (a)(i) and the economic and community value to be received in exchange for the assets described in (a) (i) have been considered.
b) In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R878 promulgated on 22 August 2008, Council approves in principle the transfer Erf 104331, Cape Town as described in (a)(i);
c) Erf 10433, situated at 5 Cherry Close, Cape Town, be transferred by way of
public competition, subject to Conditions to be imposed by Director: Property Management in exercise of her delegated authority;
d) The comments and recommendations provided by Western Cape Provincial Treasury, be noted.
