Resolution detail

It was RESOLVED that Subcouncil 15 SUPPORTED the recommendations and RECOMMEND to Council that:
 

1. In terms of sections 14(2)(a) and (b) of the Local Government: Municipal Finance Management Act (MFMA), Act 56 of 2003:

 

1. Council resolve that portions of erven 32403, 112692 and 2197, Cape Town, situated off Gunners Circle, Epping Industria 1, approximately 4.14ha in total, zoned Limited Use, Transport Zone 1: Transport Use, Transport 2 Public Road and Public Parking, shown lettered ABCDEFGHIJKLMNPQRSTUVW on Plan LIS 2370, attached to the report as annexure A, is not required for the provision of the minimum level of basic municipal services;

 

2. In terms of regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approve in principle the sale of portions of erven 32403, 112692 and 2197, Cape Town, situated off Gunners Circle, Epping Industria 1;

 

3. Council confirms that regulation 5(10(a) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, has been complied with as the capital asset proposed to be transferred or disposed is a high value capital asset.

 

4. Council resolve that portions of erven 32403, 112692 and 2197, Cape Town, situated off Gunners Circle, Epping Industria 1 be sold by public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.

 
FURTHER RESOLVED that the report proposed granting of in-principle approval for the sale by public competition of portions of erven 32403, 112692 & 2197, to be consolidated as one erf, being 'the subject property', Cape Town, situated off Gunners Circle, Epping, Industria 1 BE SUBMITTED to the next Ward 53 Committee Meeting for NOTING.
