Resolution detail

RESOLVED to RECOMMEND that the lease of portion of public street, being a portions of erven 652 and 51 Hout Bay situated at Liverpool Street, Hout Bay, shown hatched and lettered ABCDEF on the Plan LT793v2 marked annexure A, attached to the report in extent approximately 390m², to Graham Sleigh, owner of Erf 3758 Hout Bay or his successors in title, BE APPROVED subject to inter alia the following conditions:

1. A tariff rental of R2 193,91 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
    
2. The lease will endure for a period of ten years, with an option to renew for a further ten years;
    
3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
    
4. The property be used for gardening and security purposes only;
    
5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
    
6. Subject to compliance with any other statutory requirements;
    
7. No compensation will be payable for any improvement made to the property.
    
8. Electrical services exist on the property. The City of Cape Town reserves the right to construct and/or erect and lay such poles, stays, cables, wires or appurtenances relating thereto as may be necessary, together with the right to use, inspect, maintain, repair, alter, relay and/or remove all such poles, stays, cables, wires or appurtenances aforesaid. This includes the right to bring machinery onto the property and to carry out excavations.
    
9. The City of Cape Town and its employees or contractors shall have the right of access at all times for the purposes of maintenance and repair to services as and when required;
    
10. No building, containers or structures shall be erected within 3 meters of Electrical Services;
     
11. No excavation or filling shall be carried out within the lease area without the prior written consent of the Director: Electricity Services via the wayleave approval process. All excavations within 3 meters of the electrical services must be carried out under the direction of a representative of the Electricity Department.
12. No stakes, pegs or pins shall be driven into the ground within 1 meter of any electrical services
13.  No mechanical plant may be used within 3 meters of medium voltage cables or 5 meter of high voltage cables.
14. Telkom services exist on the property or in its vicinity. It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant not indicated on the plan;
15.  24-hour access to Telkom services must be available in order to carry out maintenance or upgrade existing plants at all times.
16. Adherence to City of Cape Town’s water by-laws.
