The Subcouncil support and recommend

The comments received from the 30-day public participation process as per Section 6 of the Informal Trading By-law and that the responses from Area Economic Development BE NOTED by Subcouncil 11.

Is further recommended that the subcouncil 11 recommend that the Executive Mayor recommend to Council that:

In terms of section 6.9 of the City of Cape Town’s Informal Trading By-law, the Informal Trading Plan for a portion of ward 46 along Klipfontein Road btween Yusuf Gool Boulevard and Johnston Road and trading along Johnston Road between Klipfontein Road and College Road as shown in Annexure A, maps 1-6, BE ADOPTED as being an area in which the carrying on of the business of Informal trading is permitted.

The areas of the Gatesville CBD along Klipfontein Road between Yusuf Gool Boulevard and Johnston Road and trading along Johnston Road between Klipfontein Road and College Road, as indicated on Annexure A, maps 1-6, BE DECLARED as demarcated areas in which the carrying on of the business of Informal Traders is allowed to persons in possession of a valid permit from the City of Cape Town.

The previous proclamation of the informal trading plan for the Gatesville area as published in Provincial Gazette no.5413 dated 21 January 2000 BE REVOKED.

The informal trading bays as stated in Annexure A, maps 2-6, be let out by means of a permit system and that no informal trading be permitted in these demarcated informal trading bays if a person is not in possession of a valid permit issued by a specifically authorised employee, agent representative and/or service provider of the City of Cape Town.

The area stated in Annexure A, map 2, along Klipfontein Road be converted to a weekend market where trading is permitted from 07h:00-18h:00 on Saturdays and Sundays.

A portion of the area in Annexure A, mao 2B (bays 1-40) trading will be permitted for 7 days a week for traders who are trading every day between the hours 07h:00-18h:00.

Trading areas in Annexure A, maps 3-6, along Klipfontein Road between Hazel Road and Johnston Road and trading bays along Johnston Road between Klipfontein and College Road will be permitted 7 days a week between the hours of 07h:00-18h:00.

The comments received from the 30-day public participation process as per Section 6 Development BE NOTED by Council.

The objections not be upheld.

The approved informal trading plan for Ward 46 BE PUBLISHED in the Provincial Gazette in terms of the Informal Trading By-law.
In addition, the members of the Subcouncil supported the following comments made by the ward Councillor, Councillor A Cassiem and should be incorporated into the report to serve before MAYCO and Council.

Recognition of Gatesville Informal Trading Association (GITA) and Rylands Informal Trading Association (RITA).to be officially recognised at Sub Council level. The two organization need to be engaged to raise the importance of registering their respective bodies.in the sub council database the responsibility is for AED to do the above. RITA is a body comprising of historical informal Traders and must be accommodated in this Review Plan, hence it is instrumental to engage property management as soon as possible with all stakeholders

The parking will be an immense challenge. Currently traders formal and informal utilise parking as close as possible to their locations due to car break-ins and harassment by illegal car guards. It is recommended in this regard is that dedicated employees to manage the Safety and Security of the designated parking space. Ideally to enclose the parking areas with dedicated security personnel. This, enclosed parking space, should still be vigorously pursued.

The enforcement should be a prominent feature to make sure all stakeholders to the space/ precinct should adhere and comply to City by-laws. Notwithstanding that we do not want to see new informal traders start making "shop" in the previous locations, i.e. the locations prior to the Implementation of this Review. The aforementioned I cannot stress more.

The 24 Traders, from the Hazel Road site, should maintain their bays, however it should include a portion of the dual way in close proximity to the bays. The bays reinforced with bollards for their safety. Culminating in a one way down the Klipfontein service road with parking bays amended acutely, i.e. at a 45-degree angle. This will allow for effortlessly parking and reversing in the one-way road. The recommendations will profoundly alleviate the traffic congestion at the Hazel Road intersection.

I agree and support the Review Report in the hope that all informal traders, legally there, are pleased with their proposed location in the parking space which will now allow for much bigger bays.
