RESOLVED TO RECOMMEND
Subcouncil 4 resolved that the Proposed Closure and Granting of In-Principle Approval for the Transfer by Public Competition, of the City-Owned Vacant Erven 2100 and 2087, Situated at 139 Kimberley Road and 137 Caledon Street, Townsend Estate, Goodwood Zoned Open Space 2: Public Open Space (OS 2) BE APPROVED, subject inter alia to the following conditions, that;
a) In terms of section 14 (2)(a) and (b) of the Municipal Finance Management Act (MFMA), Act 56 of 2003:
i) Council resolves that Erven 2100 and 2087, respectively at 139 Kimberley Road and 137 Caledon Street, Townsend Estate, Goodwood, in extent approximately 987m², and 503m², zoned Open Space 2: Public Open Space (OS 2) on the attached Plans LIS 2105 and LIS 2087, not be required for the provision of the minimum level of basic municipal services.
ii) Council confirm that fair market value of the assets described in (a)(i) and the economic and community value to be received in exchange for the assets described in (a)(i) have been considered.
b. In terms of regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R.878 promulgated on 22 August 2008, Council approves in principle the transfer Erven 2100 and 2087, respectively situated at 139 Kimberley Road and 137 Caledon Street, Townsend Estate, Goodwood as described in (a)(i);
c) Erven 2100 and 2087 situated at 139 Kimberley Road and 137 Caledon Street, Townsend Estate, Goodwood be transferred by way of public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
d) In terms of Section 4 of Council’s Immovable Property By-Law 2015, Council approves the public place closure of Erven 2100 and 2087, situated at 139 Kimberley Road and 137 Caledon Street.
e) Comments provided by the Body Corporate of Jorene Court situated at Erf 21761 Townsend Street, Goodwood be noted.
