It is RECOMMENDED that

In terms of Sections 14(2)(a) and (b) of the Municipal Finance Management Act, Act 56 of 2003 (MFMA):
-
Council resolves that Erf 16269, portion Remainder Erf 16157 Kuils River, situated at 23 Carrick Street, Kuils River, in extent approximately 2346m² (see Annexure A to the report for Plan LIS 2152), be regarded as not being required for the provision of the minimum level of basic municipal services; and
-
Council confirms that the fair market value of the asset described in (a)(i) and the economic and community value to be received in exchange for the asset described in (a)(i) has been considered.

In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations of 2008 (MATR), Council approves in principle the transfer of Erf 16269, 23 Carrick Street, Kuils River, as described in (a)(i); and
-
Erf 16269, portion Remainder Erf 16157 Kuils River, situated at 23 Carrick Street, Kuils River, be transferred by public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
