Subcouncil 6 supported and noted the report and recommended to the Director: Property Management that the lease of portion of public road, a portion of (Public Open Space) being Erf 14930 situated at Belhar, Bellville, shown hatched and lettered ABCD on the attached sketch TA 960v1 marked annexure A to the report, in extent approximately 164m², to Mrs Ariefa Sadeer, owner of Erf 14944 or his successors in title, be approved subject to inter alia the following conditions:

A tariff rental of R1 096,52 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
-
The property be used for garden and security purposes only;
-
Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirements;
-
No compensation will be payable for any improvement made to the property;
-
All outstanding accounts with the City of Cape Town must be settled;
-
The subject area proposed for lease is erf 14930 Bellville, zoned OS2 for security purposes and gardening purposes. IPP does not oject to the proposed lease and bring to your attention that should the lease application be approved by the Director Property Management the signed lease must be made available to IPP in order to ensure that the City’s IPAR is updated.

There is no construction allowed over the sewer;

The lease to be permitted for safety and gardening only;

Works will be carried out as indicated on plans;
-
No mechanical plant to be used within 3,0m of Eskom underground cables;
-
All services to be verified on site;
-
Cross trenches to be dug by hand to locate all underground services before construction work commences;
-
If Eskom underground services cannot be located or is grossly misplaced from where the wayleave plan indicates then all work is to be stopped
-
In cases where proposed services run parallel with existing underground power cables the greatest separation as possible should be maintained with a minimum of 1000mm
-
Where proposed services cross underground power cables the separation should be a minimum of 300mm with protection between services and power cables
-
No manholes; catch-pits or any structure to be built on top of existing underground services;
-
Only walk behind (2ton Bomac type) compactors to be used when compacting on top of a 1 meter either side of underground cables;
-
If underground services cannot be located, then the CNC should be consulted before commencement of any work.

No mechanical plant to be used within 3m of Eskom 11kV/LV Overhead Power lines

Openserve infrastructure will not be affected, however care should still be taken should it be evident that there is in fact Openserve network present on the actual sites.
