PROPOSED LEASE OF CITY LAND, BEING OF PORTION OF ERF 150 ALBERT ROAD, HOUT BAY: BRAIN CLIVE CHALENOR BARSON
RESOLVED to RECOMMEND that the lease of portion of City land, being a portion of Erf 150 Hout Bay situated at Albert Road, Hout Bay, shown hatched and lettered ABCD on the plan LT 214v4 marked annexure A attached to the report, in extent approximately 117 m², to Brain Clive Chalenor Barson, owner of Erf 4377 or his successors in title, BE APPROVED subject to inter alia the following conditions, that:

A tariff rental of 1 096.52 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years with the option to renew for a further ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for gardening purposes only and no structure other than the existing structures will be permitted within the lease footprint;

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

Subject to compliance with any other statutory requirements;
-
No compensation will be payable for any improvement made to the property;

Adherence to the requirements of the City of Cape Town’s by-laws;

Should the lease be cancelled or required for Road or Storm water purposes, the lease area may be required to be reinstated to the original natural state, to the satisfaction of Transport Impact Assessment (TDA);

Electricity services exist within the vicinity of the lease area and any alterations or deviation to electricity services necessary as a consequence of the proposal or requested by the applicant will be carried out at the applicant’s cost;

No Telkom services are known to exist within the lease area but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
-
Telkom requires access to carry out maintenance or upgrade existing plants at all times;
-
Sewer crosses the area in question and no excavation or filling shall be carried out within the area without the prior written consent Council;

Manholes to be accessible at all times for maintenance and repair purposes and a 24 cell phone number to be available;
-
No trees shall be planted over the sewer traversing the property
