RESOLVED TO RECOMMEND:
-
That it BE RECOMMENDED that the lease of a portion of City owned land, being Erf 12517 Durbanville, situated at De Villiers Street, Durbanville, as reflected on page 223 of the agenda indicated as lettered ABCDEF on the Plan No TA 470v1 marked Annexure A, in extent approximately 1ha, to Scouts South Africa, a registered non-profit organization (019-215 NPO) or its successors in title, be approved subject to inter alia the following conditions, that:

A tariff rental of R966,09 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The lease will endure for a period of two years, subject to a notice period of 3 months;
-
The property be used only for activities relating Scouts South Africa;
-
Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirements;
-
No compensation will be payable for any improvement made to the property;
-
The tariff rental assumes that the Lessee will be responsible for all maintenance and repairs of the premises;

The applicant must comply with the Noise Control Regulations P.N. 200/2013 by not creating a disturbing noise nuisance to surrounding property owners and any noise producing plant or equipment must be adequately muffled;

The premises must comply with the requirements of the Tobacco Products Control Act, Act 83 of 1993, and the Notice Relating to Smoking of Tobacco Products in public places, Regulation No R975 dated 29 September 2000;

The applicant must maintain the property in a neat and tidy condition at all times so as not to cause a health nuisance.
2. That the alternative proposal submitted by the Olympians not be approved.
FURTHER RECOMMENDED

That the below-mentioned recommendation of Subcouncil 7 BE INCLUDED in the application to be submitted for consideration:

All sublease applications in respect of this property to be referred to Subcouncil for comment prior to consideration by the delegated authority;

That the leased area be optimised for use by other community organisations.
