Resolution detail

RECOMMENDED that,

the lease of portion of public place, being a portion of Erf 2724 Simon’s Town situated at Rickett’s Close, Simon’s Town, shown hatched and lettered AB curve CDE on the attached Plan LT 675v3 marked Annexure A, in extent approximately 714 m², to Robin Castell, owner of Erf 2703 Simon’s Town or his successors in title, be approved subject to inter alia the following
conditions:
 

1. A tariff rental of R3 289,57 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;   
2. The lease will endure for a period of ten years with an option to renew for a further 10 years;          
3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;        
4. The property be used for gardening purposes only;    
5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;                                         
6. Subject to compliance with any other statutory requirements;                                                  
7. No compensation will be payable for any improvement made to the property;                        
8. No structures other than the existing structures will be permitted within the lease perimeter;                   
9. Any alterations or deviations to electricity services necessary as a consequence of the proposal or requested by the applicant, will be carried out at the applicant’s cost;                                                    
10. Electrical infrastructure may exist in the vicinity of the lease area. A wayleave must be obtained from electricity Services department before any excavation work can commence. Contact the Drawing and Record Office:
