RESOLVED
 
Subcouncil 18 SUPPORTED that:
 
It is recommended that the lease of City land, being a portion of erf 2712 Ottery, situated at Cranborne Road, Ottery, shown hatched and lettered ABCD on the attached plan LT 1543v1, to  Mogamat Ashraf Cottle and Armiena Cottle, owners of erf  2910, or their successors in title, in extent approximately 37 m², be approved subject inter alia to the following conditions:
 

  1. A tariff rental of R548,70 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable.  Rates not applicable;
 
  1. The lease will endure for a period of ten years with an option to renew for a further 10 years;
 
  1. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
 
  1. The property be used for gardening and security purposes only;
 
  1. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
 
  1. Subject to compliance with any other statutory requirements;
 
  1. No compensation will be payable for any improvement made to the property.
 
  1. No fencing other than existing boundary fencing will be permitted within the lease area.
 
i)             Any boundary fencing must be of a non-permanent, visually  permeable type and will be subject to:
 
ii)            The submission and approval of any necessary building plans in terms of the National Building Regulations if applicable;
 
iii)           Any fencing that does not require the submission of plans in terms  of the National Building regulations will still require the approval of the Director: Property Management.
 
  1.      Any alteration or deviation to electricity services necessary as a consequence of the proposal, or requested by the applicants will be carried out at the applicants’ costs;
              
                  j)      Adherence to the requirements of the City of Cape Town’s water by-law;
 
k)           It is the responsibility of the applicants to notify Telkom immediately should the applicants locate any Telkom plant which may not be indicated on the plan;
 
l)             Telkom requires access to carry out maintenance or upgrade existing plants at all times;
 
m)           For the reasons set out in the content of the report, the objections submitted by Traffic Department and Land Use Management Department, not be upheld, and that the lease of a portion of City land, being a portion of erf 2712 Ottery, to Mogamat Ashraf Cottle and Armiena Cottle, be proceeded with.
