PROPOSED GRANTING OF RIGHTS FOR THE USE AND MANAGEMENT OF AN EARLY CHILDHOOD DEVELOPMENT FACILITY ON ERF 100836, SITUATED IN HOGSBACK ROAD, HEIDEVELD, CAPE TOWN TO FIFTH AVENUE DAY CARE (A NON PROFIT ORGANISATION (NPO)
The Subcouncil Manager Ms Kayise Nombakuse informed the members that the report served twice at the Subcouncil and was deferred. She added that this is the 3rd time that the report will be serving at the Subcouncil and asked the members of the Subcouncil take a decision weather report be supported or not supported.
Cllr Moses informed the members that the Subcouncil administration facilitated skype meetings to discuss concerns however experienced technically challenge getting officials together with Director of SDECD Mr A Sauls to resolve certain questions.
Cllr Moses raised the following concerns and requested further information from the Line department and quoted Subcouncil delegation part 24 section 10 Letting of Property and Property Matters.

To comment to the competent authority on the granting of rights to use, manage or control City immovable assets as land, property and buildings and to recommend conditions of approval where deemed necessary

To recommend to the competent authority, the approval or refusal of any applications from non-governmental organisations or registered neighborhood watches to waive or adjust payment of a site rental fee received from any such organization.

To comment to the relevant authority on the reservation of property for municipal purposes, within the Subcouncil’s area of jurisdiction.

that the ECD Centre of Excellence Erf 100836 relate to the building and requested that the report should be specific it is only the ECD being leased. The extra building will be used for Municipal purposes.

Cllr Moses referred to page 169 of the Subcouncil agenda and informed members that the Subcouncil was not privileged to all supporting documents submitted by potential service providers who applied for the management of the ECD and information required as applicants that were unsuccessful and reasons for rejection.

Previous Area Manager of SDECD was not part of process

Section 12 Rules of Order for Subcouncil Meetings of City of Cape Town; A Subcouncil may not make decisions or recommendations unless it has sufficient information in written report, including the legal and financial implications.

The Report submitted is not signed by legal department and Finance Representative.

RESOLVED
The members of the Subcouncil unanimously did NOT SUPPORT the report subject to the amended report submitted by the Line Department which will take cognizance of the Part 24 of Subcouncil Delegations and Rules of order of Subcouncil meetings of City of Cape Town with specific reference to the following provisions

Part 24 of Subcouncil delegations section 10 dealing with Letting of property and property matters
