RESOLVED

1. That Wolfgat Subcouncil 12 REFUSE the application for a
     liquor licence received from Margies Place, Mitchells Plain for
     the extension of trading days and hours – Monday to
     Saturday from 18:00 to 20:00 for Consumption OFF
     premises, Reference no WCP/038139, Erf 23373, 10
     Temporal Street, Rocklands, Mitchells Plain for the following
     reasons:

That Traffic Services Do Not Support the application because the outlet is in a residential area with no provision for extra parking;

That the premises are in close proximity to Caradale Primary, Spine Road High and ACTS Mission Church
That SAPS DLO has objections to the application namely:

There is no parking at the premises;

Numerous complaints of noise, parking and of trading after normal trading hours up to early hours of the morning;
Complaints of attacks on police, malicious damage to property, dealing in liquor after normal trading hours resisting arrest and interfering in Police duties. All of the above happened on 31 May 2019. Case docket was opened M/plain CAS25/06/2019. Section 73(7) (c) report of the Liquor Act 04/2008 for Margies Place WCP/038139 was compiled and forwarded to the Liquor Authority.
On 23 December 2019, the license was served a fine of R60 000 by the Liquor Authority for contravening Section 59(8) of the Act, as liquor was sold on 31 May 2019 after normal trading hours as per the Municipal By-Laws;
On 27 December 2019, as search warrant was executed at Margies Place by members of TRT at 14:45 after receiving information of drugs being sold from the premises. SAPS 13C reference no.181/12/2019.
