Subcouncil 6 recommended to the Director: Property Management that the proposed lease of a portion of public street, being a portion of Erf 12195-RE Bellville, shown hatched and lettered ABC on the attached plan TA 806v1, marked Annexure A to the report, in extent approximately 74m² to Mr Johnathan and Christina Daleen January, the owners of Erf 13204 Bellville, or their successors-in-title, be approved subject inter alia to the following conditions that;

A tariff of R 418.26 per annum exclusive of VAT be calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

The lease will endure for a period of ten years;

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

The property be used for garden purposes only;
-
Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
-
Subject to compliance with any other statutory requirements;

No compensation will be payable for any improvement made to the property;
-
All outstanding accounts with the City of Cape Town must be settled;
-
No permanent or temporary structures will be permitted on the leased property;
-
Access must be granted to the City of Cape Town employees upon request to perform maintenance/repair work;
-
No storage of materials or rubble is allowed within 1m of any part of the electricity services;
-
No structures shall be erected within 1m of any electrical services;
-
No excavations or filling shall be carried out without the prior consent of the Electricity Services Department
