APPLICATION FOR EXTENSION OF LIQUOR TRADING HOURS IN RESPECT OF HEIDEVELD LIQUOR STORE CC EXTENSION OF TRADING HOURS FROM 11:00 TO 18:00, SUNDAY FOR PREMISES OFF-CONSUMPTION
 
The Subcouncil Manager informed the members that the purposes of the report is for the Subcouncil to decide on an application for extension of liquor trading hours in respect for Heideveld Liquor Store CC (Off Consumption 11:00 to 18:00) in terms of Section 6(1) of the City of Cape Town: Control of Undertakings that Sell Liquor to the Public By-Law 2013. She informed the members of the Subcouncil that public participation process was undertaken and comments received are attached as Annexure 1- 12 appended to the report.
 
Cllr Moses informed the Subcouncil members that the premises is located near schools, Library, Cathkin Community Hall, Apostolic Church, Old Age Home and New ECD which are all public facilities.The Ward Committee Sector members and SAPS do not Support the application due to nummerous transgressions and anti-social behaviour around the premises in question. The situation is monitored, substantial evidence such as the photos, video footage has been collated. He said people are enslaved in alchol from 10:am till late at night and for the outlet to cater for people coming late from work the law is not in favour of the community interest. Cllr Moses said he does not support the application and recommends that current licence be revoked.
 
Cllr Achmat informed Subcouncil members that the Ward Committee Sectors are claiming all the irregularieties and all the community facilities arround the Applicants premises, is it possible for closing down  the premises.
 
RESOLVED
 
The Subcouncil considered the application for the extension of liquor trading hours submitted by HEIDEVELD LIQUOR STORE, 3 POSTERN ROAD HEIDEVELD 7764  as well as the various comments received, and resolve to NOT SUPPORT the application for extension of trading hours, off-consumption (Sunday, 11:00 until 18:00) for the following reasons
 
  • The granting of application for extension of liquour trading hours will impact the community negatively, contrary to the provision of sections 34 of the Wester Cape Liquor Act in that
  1. The granting thereof is NOT in public interest;
 
     e)   The granting of the application does  prejudice-
  1. The residents of a residential area;
  2. The residents of an institution for the aged or frail;
  3. The leaners of an educational institution who are under the age of eighteen (18) years;
  4. The patients of an institution for drug or alcohol related dependencies; or
  5. The congregants of a religious institution located in the vicinity of the proposed licensed premises
