Resolution detail

It is recommended that the proposed lease of a portion of City owned land being a portion of open public space Erf 21742 Parow shown hatched and lettered ABC on the attached plan TA 373v1, marked annexure A, in extent approximately 477 m² to the Bastiaan Hendrick Koster, the owner of Erf 20944 Parow or their successors in title be approved subject inter alia to the following conditions that;
 

1. A tariff of R 2 612.17 per annum exclusive of VAT be payable; Rates not applicable

2. The lease will endure for a period of ten years;

3. The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

4. The property be used for garden purposes only;

5. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

6. Subject to compliance with any other statutory requirements;

7. No compensation will be payable for any improvement made to the property;

8. All outstanding accounts with the City of Cape Town must be settled;

1. No structure be erected or constructed across the lease area;

10. Access to swimming pool to comply with the requirements of SANS 10400 Part D;

11. Nature Reserve has no objection leasing part of Erf 21742 as we have been in negotiations with Property Management however the portion being leased will always remain a part of the Tygerberg Nature Reserve and is proclaimed as a Section 23 Nature Reserve the land will always belong to the City and be part of the Reserve and therefore cannot be sold.
