Subcouncil 4 resolved that the lease of a portion of the remainder of Erf 7597 Goodwood, situated at Van Rensburg Road, Goodwood and marked as ABCD on the Plan No TA 978v0 attached and marked Annexure A, in extent 198 m², to Ivy Noziyalo Madikiza or her successors in title, BE APPROVED subject to inter alia the following conditions, that:

A tariff rental of R1 044,35 per annum exclusive of VAT be payable.

The lease will endure for a period of ten years.

The rental will be adjusted annually in terms of the rental tariff structure as approved by Council.

The property be used for gardening and security purposes only.

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority.

Subject to compliance with any other statutory requirements.
g. No compensation will be payable for any improvement made to the property.

No buildings or structures of any kind may be erected on the property.

The City of Cape Town has the right to construct, erect or lay such poles, stays, cables, wires or appurtenances relating thereto as may be necessary, together with the right to use, inspect, maintain, repair, alter, relay and/or remove all such poles, stays, cables, wire or appurtenances. This includes the right to bring machinery onto the property and to carry out excavations.

The City of Cape Town has the right for any employee or servant or contractor of the City to enter and be upon the property at any time in the exercise of the aforesaid rights and to have access to any and all services located on the property.

No building, container or structure may be erected or placed within 3 m of the electrical services.

No excavation or filling may be carried out within the leased area without the prior written consent of the Director: Electricity Services via the wayleave approval process. All excavations within 3 m of the electrical services must be carried out under the supervision of a representative of the City and notice must be given to the City at least two weeks prior to commencement of work.
m. No stakes, pegs or pins may be driven into the ground within 1 m of any part of the electricity
services and no plant or material may be stored within 1 m of any part of the electricity services.
n. No mechanical plant may be used within 3 m of medium voltage cables or 5 m of high voltage c
cables.
o. The area must remain open and enclosing the area is not permitted.

The applicant may not remove any boundary wall or fence common to the leased area.

No structures may be erected over the sewer mains.

No trees with invasive roots may be planted on the area.

Upon termination of the lease, the area must be restored to a conditions acceptable to the City of Cape Town.
