Subcouncil 4 resolved that the lease of a portion of City land, being a portion of the remainder of Erf 32585 Cape Town, situated off Bofors Circle, between Dacres and Christian Avenues, Epping and as shown hatched and lettered ABCDE on Plan No TA 753v1 attached and marked Annexure A, in extent approximately 672 m², to Rencape Investments (Pty) Ltd or its successors in title, BE APPROVED, subject inter alia to the following conditions, that:
 
                   a.     A market rental of R4 500 per month exclusive VAT and inclusive of rates be payable. 
  1. The lease will endure for a period of 10 years, subject to a review of the rental after a period of 5 years.
     
  2. The monthly rental is to be adjusted on the basis of 8% per annum compounded annually on a pro rata basis commencing 6 months from date of this valuation. Accordingly, the above recommended rental is to be adjusted as from 2019-06-01.
     
  3. The property be used for parking and storage purposes only.
     
  4. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority.
     
  5. Subject to compliance with any other statutory requirements.
     
  6. No compensation will be payable for any improvement made to the property.
     
  7. No structures may be erected on the property.
     
  8. No lease agreement will be concluded until such time that a valid Tax Certificate has been received from the applicant.
     
  9. Six (6) meter wide vehicle service gates must be installed in the fences at points A and B and E and D as per Plan No TA 753v1, to allow neighbouring businesses at the North end to receive rail freight.
     
  10. Should a need arise to lift and replace the existing rail tracks, a written application to do so must be made to the City of Cape Town to verify, prior to Transnet’s approval. Additionally, the applicant will be liable for any costs incurred in that instance and the old tracks must be handed over to Transnet.
  11. Railway blocks (as per Transnet specifications) need to be installed at rail tracks where the area is going to be used for storage and parking.
                   m.  Any form of filling or surfacing proposed within the leased area must be to the approval of the City 
                          of Cape Town. 

                   n.   The lease area must be restored to its original condition and to the satisfaction of the City of Cape
                         Town upon termination of the lease.
