 UNANIMOUSLY RESOLVED to RECOMMEND that the lease of City land being portions of Erven 95694, 95697, 95698, 95699, 956700, 95703, 95675 and 95676 Cape Town, situated at Corner of Mill and Hopeville Street, Gardens, shown hatched and lettered ABCDEFG on the sketch 3020 marked annexure A attached to the report, in extent approximately 402 m², to Dakin Graig Parker owner of remainder Erf 95679 or his successors in title, BE DEFERRED to the Property Department, to submit an urgent report, which includes the following, as per the proposal that was submiited almost 2 years ago
 

  1. That the lease area be extended
  2. That the existing renewal be included in this space.
  3.  A full report be submitted to subcouncil  giving a direct update on the following:
  • Where is this lease application?
  • Who received this application?
  • Who has initiated this application and what has been done over the last two years?

RESOLVED to RECOMMEND that the lease of City Land, being a portion of Erven 95694, 95697, 95698, 95699, 95700 and 95703 Cape Town situated on the corner of Mill and Hopeville Street, Gardens, shown hatched and lettered AB curve CDE on the sketch STC 3666v1 marked annexure A attached to the report, in extent approximately ±832m², to Hopeville/Courville Homeowners Association or their successors in title, BE APPROVED subject to inter alia the following conditions:

a) A tariff rental of R3 783.00 per annum including VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

b) The lease will endure for a period of ten years;

c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

d) The property be used for gardening and security purposes only;

e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;

f) Subject to compliance with any other statutory requirements;

g) No compensation will be payable for any improvement made to the property
