The Subcouncil unanimously agreed to support the recommendation of the report.
RESOLVED
It is recommended that the lease of portions of City Land, being portions of Erven 7619 and 7622 Parow, situated at Weimar Street, Glenlily, Parow and as shown hatched and lettered ABCDE on the Plan No TA 434v0 attached and marked annexure A. in extent approximately 509m², to Big Apple Motors CC or its successor in title, BE APPROVED subject inter alia to the following conditions, that:
a) A market rental of R8 000 per month exclusive of VAT and inclusive of rates be payable;
b) The lease will endure for a period of 10 years, subject to a review after 5 years;
c) The monthly rental is to be adjusted on the basis of 8% per annum compounded annually commencing as from date 2018-04-01;
d) The property be used for parking of customers and staff purposes only;
e) The property may not be used for trading purposes;
f) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
g) Subject to compliance with any other improvement made to the property;
h) No compensation will be payable for any improvement made to the property;
i) No lease agreement will be concluded until such time that a valid Tax Certificate has been received from the applicant;
j) The lease area must be sloped towards Weimar Street to accommodate stormwater drainage;
k) Access must be granted to City officials for the maintenance and repairs of the electrical substation situated on the property at all times.
