Subcouncil 18 RECOMMENDS that the lease of portion of public street, being a portion of Erf 127708 Cape Town situated at Shrike Crescent, Seawinds, shown hatched and lettered ABCD on the plan LT 662v3 marked annexure A, in extent approximately 47 m², to Stanley Martin and Jo Anne Martin, owners of Erf 123840 or their successors in title, be approved subject to inter alia the following conditions, that:
a) A tariff rental of R418,26 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;
b) The lease will endure for a period of ten years with an option to renew for a further 10 years;
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for gardening and security purposes only;
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) No compensation will be payable for any improvement made to the property.
h) Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost.
i) No excavation is to take place on site without the possession of a wayleave and work permit. The Electricity Department must be contacted prior to the commencement of work.
j) The applicant must adhere to the requirements of the City of Cape Town’s water by-law.
