RESOLVED TO RECOMMEND
Not Delegated: Final decision Council and noting by Subcouncil 7
It is recommended that:
a) In terms of Sections 14(2)(a) and (b) of the Local Government: Municipal Finance Management Act (MFMA), Act 56 of 2003:
i) Council resolve that Erven 11210 and 11211, Durbanville, 27 and 25 Iris Street, respectively measuring approximately 867m2 and 853m2 in extent (see Annexure A1 –A2 for the Plans LIS 1876 and1877 reflected on agenda pages 427 and 428), be regarded as not being required for the provision of the minimum level of basic municipal services; and
ii) Council confirm that the fair market value of the assets described in (a)(i) and the economic and community value to be received in exchange for the assets described in (a)(i) have been considered;
b) In terms of Regulation 5(1)(b) of the Municipal Asset Transfer Regulations (MATR), R. 878 promulgated on 22 August 2008, Council approve in principle the transfer of Erven 11210 and 11211, Durbanville, 27 and 25 Iris Street, as described in (a)(i); and
c) Erven 11210 and 11211, Durbanville, 27 and 25 Iris Street, be transferred by public competition, subject to conditions to be imposed by the Director: Property Management in the exercise of her delegated authority.
