RESOLVED TO RECOMMEND
Subcouncil 20 supports the recommendation that the lease of portion of public street, being a portion of Erf 3668 Constantia situated at Fir Lane, shown hatched and lettered ABCDEF on the attached sketch NP 27721 marked annexure A, in extent approximately 5m², to Dudley William Morrissey, owner of Erf 5918 or his successors in title, be approved subject to inter alia the following Conditions that:
a) A tariff rental of R418.26 per annum excluding VAT calculated at the rate
applicable at the time of transaction be payable. Rates not applicable;
b) The lease will endure for a period of ten years with an option to renew for
a further ten years;
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for security purposes only and no structures other
than the existing structures (palisade fence) will be permitted within the
lease perimeter;
e) No electricity services exist within the vicinity of the lease area but any alterations or deviations to the electricity services necessary as a consequence of the proposal, or requested by the applicant will be carried out at the applicant’s cost;
f) No Telkom services are known to exist within the vicinity but it is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicted on the plan;
g) As the subject property (Erf 3668 Constantia) has already been fenced, the necessary consent application for air and underground rights has to be made to the Planning and Building Development department;
h) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
i) Subject to compliance with any other statutory requirement;
j) No compensation will be payable for any improvement made to the property.
