It was NOTED that an application for a liquor licence received from Golden Tiger Cuisine was considered in terms of sub delegated authority and that the following recommendation was forwarded to the Liquor Authority in terms of the Western Cape Liquor Act, 2008, as amended:
Subcouncil 3 recommended that the application for a Consumption ON Premises Liquor Licence, reference no. LLA1804001, for the business Golden Tiger Cuisine CONDITIONALLY SUPPORTED
Subject to:
1. Application must be made for a Business Licence in terms of the Businesses Act No 70 of 1991 and a Certificate of Acceptability for Food Premises in terms of Regulation R962 dated 23/11/2012 promulgated under the Foodstuffs, Cosmetic and Disinfectants Act, 1972 (Act 54 of 1972).
2. Should the premises be used for entertainment, application must be made for the relevant Business Licence in terms of the Businesses Act No 70 of 1991 – Item 2 (Entertainment).
3. Building plans must be submitted for any new building work and/or alterations to the existing building. All areas of the premises must be adequately through or cross ventilated to the external air. Should mechanical ventilation be used, details thereof must be provided on a building plan for comment and approval.
4. Facilities must be provided for persons with disabilities in accordance with SANS 10400 –S: 2011 Edition 3. This includes ramps/walkways, toilet facilities and removal of obstructions in the path of travel of disabled persons.
5. Adequate toilet facilities must be provided for staff and clientele in accordance with SANS 0400 of 1990 (Table 6).
6. The premises must comply with the Western Cape Noise Control Regulations P.N. 200/2013 by not creating a disturbing noise or noise nuisance to surrounding property owners. A noise impact assessment and adequate soundproofing of the premises may be called for should it be deemed necessary.
7. The premises must comply with the Tobacco Products Control Act (Act no 83 of 1993 as amended) and all relating Regulations.
8. The premises must be made rodent proofed in accordance with the Government Rodent Proofing Regulations.
9. All refuse must be stored in such a manner so as not to create a health nuisance pending removal.
10. The premises must comply with the City of Cape Town: Control of undertakings that sell liquor to the Public By- Law, 2013.
11. Submit a a separate detailed Fire Protection Plan to Local Authority.
12. Submit a LP Gas Plan to Local Authority.
13. Apply for a Population Certificate.
14. Apply for a Flammable Substance Certificate for the LP Gas in excess of 200kg.
15. Ensure that the premises complies with SANS 10400 - T.
