Mr Wilson Baartman represented the Property Department.
UNANIMOUSLY RESOLVED to RECOMMEND that the lease of portion of public street being Erf 833, Hout Bay situated at Day Road, Hout Bay shown hatched and lettered ABC on the plan LT304v2 marked annexure A attached to the report, in extent approximately 272 m², to Day Street investments CC, owner of Erf 2863 or its successors in title, BE APPROVED subject to inter alia the following conditions, that:
a)A tariff rental of R1 186,84 per annum excluding VAT of 14% where applicable, being R166.16 (in total – R1 353,00) be payable;
b)The lease will endure for a period of ten years option to renew for further ten years.
c)The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d)The property be used for gardening and security purposes only and no structures other that existing structures will be permitted in the lease area;
e)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f)Subject to compliance with any other statutory requirements;
g)Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost.
h)It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might not be indicated on the plan;
i)It must be made known by the applicant that Telkom requires access to carry out maintenance or upgrade existing plants at all times;
j) If any plant not indicated and information exists and information or supervision is required please contact this office 28 hour before any work, commences;
j)A 150mm diameter water main crosses the area in question (the approximate position is showed on the Plan LT 304v2 in this regard the following conditions will apply.)
i. No excavations or filling shall be carried out within the area without prior consent of Council;
ii. Relevant employees of Council shall have the access at all times for the purpose of maintaining and repairing water main;
l) Adherence to the requirement of the city of Cape town’s water by-law;
m) No compensation will be payable for any improvement made to the property.
