The Subcouncil Manager informed the members that the report is submitted to Subcouncil for comments on the application for liquor licenses in terms of the Western Cape Liquor Act, 2008 as amended.
She informed the members that comments have been obtained from the Ward Councillor, Line department Officials, SAPS and the Community. Subcouncil to exercise the powers conferred on the City in terms of Section 6(3) of the By-law.
Cllr Ngcombolo said the Business is located near Intshinga Primary school and Seventh Day Adventist Church. Applicant did not consult the community and the community is not in Support and he neither support the application.
Cllr Moses informed the members that 15 people rejected the application and 3 people supported the application. The true response is that the business is close to two schools and a church and he do not support the application.
Cllr MF Achmat representing AL-JAMA-AH did not support the LLA application because of comments received and business is located near two schools and a church.
The Subcouncil members recommended that the application 1710023 for liquor licences in terms of the Western Cape Liquor Act, 2008 NOT SUPPORTED based on the following reasons;
1. There are public facilities in close proxmity e.g. Old Age Home, Early Childhood Development and business is located near Intshinga Primary school + - 15m away, Lihlonolo Primary school + - 20m away and Seventh Day Adventist Church.
2. Public Interest should seriously be considered and Community organisations and individual community members are not supporting the application. Application does not support public interest.
3. Health Department Vuyani Community Clinic objected sighting problems of high defaulter rate, TB and ART which is mainly due to alcohol consumption and should the application be approved justice will not be done to the care of the Community served.
4. Fire & Rescue Services commented that the above mentioned premises has to comply with the requirements of a F2 occupancy as per SANS 10400 – T : 2011. The Building has to comply with the NBR and the By – law relating to fire safety to be considered. The necessary amended plans for any internal changes taking place has to be submitted via Athlone Building Plans Department.
5. Law Enforcement Squad objected and commented that the premises is zoned for general business 4. The trading hours of the Supermarket and the selling of liquor should be clearly mentioned. Trading hours requested is not in line with the trading hours for off consumption according to the Control of undertaking By-law to sell liquor to the Public.
6. South African Police Service commented that there is limited parking and already there is a license liquor premises nearby
