RECOMMENDED that, a)Council resolve that, in terms of section 14 of the Local Government: Municipal Finance Management Act, Act 56 of 2003, the subject portion of ERF 3445 Noordhoek, situated at Longboat Road, Milkwood Park, Noordhoek, in extent approximately 219m² , shown by the figure ABCDE on the Plan No LT 1057v0 attached and marked Annexure A, is not needed to provide the minimum level of basic municipal services; and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset. b)Council approve the granting of in-principle approval for disposal of portion of Erf 3445 Noordhoek, situated at Longboat Road, Milkwood Park, Noordhoek, in extent approximately 219m² , as shown by the figure ABCDE on the Plan No LT 105v0 attached and marked Annexure A, to Sean Michael Ronald Faulkner or his successors in title for the purpose of regularizing an encroaching garage and for gardening purposes, subject inter alia to the following conditions, that: (i)A market-related purchase price of R130 000 excluding VAT of 14%, being R18 200 (in total R148 200), be payable; (ii)The purchase price is to be escalated by 6% per annum compounded annually on a pro rata basis commencing two months from date of valuation. Accordingly, the above recommended purchase price is to be adjusted as from 2017-06-01; (iii)Occupational rental in the amount of R760 per month, escalating at 8% per annum must be paid from 2017-06-01; (iv)Subject to further conditions to be imposed by the Director: Property Management in the exercise of her delegated authority; (v)Subject to compliance with any other statutory requirements; (vi)All costs related to the transaction be home by the applicants; (vii)The City of Cape Town’s water by-law be adhered to.
