Resolution detail
• Cllr Moses read sections of the Liquor Licence Act, Page 67. These sections made reference to public interest and that liquor licence application must not prejudice the public interest e.g. residents, institutions, libraries, schools, churches, theological centre, old age home and petrol stations in close proximity.
• Cllr Moses highlighted the structural alterations of suitability of the building.
• He said that he is not prejudicing against business, but trying to understand that the service is of public interest after normal trading hours.
• SAPS reports show criminal activities, a number of people been shot and killed.
• Law enforcement agencies served notice relating to contravention of City’s By - Laws and the application was not supported by SAPS.
Cllr Moses said that he is not supporting the application.
Mr Johannes Solomons also read an email dated 14 June 2017 received from the Executive Director, Dr Louis Scheepers pertaining to Liquor Licensing and Trading Hours
He has been approached by the Chief Whip on behalf of the members of the Appeals Committee. There is concern amongst the members of that Committee about the quality of some of the decisions taken by some Subcouncils in respect of liquor licensing and trading hours. He has agreed with the Chief Whip that, in order to improve this situation, he will do the following:
• Ensure that the appropriate officials from the planning department are present in Subcouncil Meetings and that they have the space and opportunity to advise the Subcouncil in respect of the planning matters
• That he will, with input from other departments, develop a guide for Subcouncils to use when they consider applications for liquor licenses and trading hours.

• Cllr Moses DA party – not supporting
• Cllr L Gungxe – ANC –not supporting
• Cllr MF Achmat - AL- JAMA -AH not supporting
• Cllr A Leitch –PA – not supporting
RECOMMENDATION:
Subcouncil 11 consider the application for extension of liquor trading hours submitted by Cameo Liquor Store, 3 Postern road Heideveld 7764 as well as various comments received, and resolve to NOT SUPPORT the application for extension of trading hours, off-consumption (Mondays to Saturdays, 18:00 until 20:00) for the following reasons;
• The intended business does not serve public interest. The building is geographically situated in close proximity of public Library, petrol station, Theological Centre, Community Facility, Old Age Home and Schools.
• Community organisations are not supporting the application given the prejudice suffered by existing public institutions in close proximity to the liquor premises.
• South African Police Service Report reveals criminal activities whilst City of Cape Town Law enforcement department confirmed that contravention notice was served. Both Law Enforcement agencies are not supporting the application.
