RESOLVED TO RECOMMEND
Subcouncil 20 recommends that the lease of City land, being a portion Erf 9295, Constantia situated at Klaasens, shown hatched and lettered ABCD on the attached sketch WT 2000858 marked annexure A, in extent approximately 4251m2, to Roy Martin Fine, owner of Erf 9296 or his successors in title, be approved subject to inter alia the following conditions, that:
a) A tariff rental of R 2 228,95 per annum excluding VAT of 14% where applicable, being R 312,05 (in total – R 2 541) be payable;
b) The lease will endure for a period of ten years with an option to renew for a further ten years;
c) The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;
d) The property be used for gardening purposes only and no fencing other than the existing boundary fencing will be permitted within the lease area;
e) Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;
f) Subject to compliance with any other statutory requirements;
g) Any alteration or deviation to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the applicant’s cost;
h) It is the responsibility of the applicant to notify Telkom immediately should the applicant locate any Telkom plant which might be indicated on the plan;
i) It must be made known to the applicant that Telkom requires access to carry out maintenance or upgrade existing plant at all times;
j) No compensation will be payable for any improvement made to the property.
