Email from Andre van Niekerk dated 20/02/19:
I was of the view that the matter had been closed. You will remember, that we scheduled a meeting where I met with Cllr Isaacs and Cllr Pringle. I explained what I understood of the original agreement between the City and Asla regarding the development (this was an old agreement that had been initiated before I started at the city). At the end of our meeting, Cllr Pringle resolved that the matter be raised with the Mayco member for TDA, Cllr Herron.
A meeting was scheduled by your office/Cllr Pringle’s office with Cllr Herron at his office at the civic. I attended the meeting, which was on the same day as a Council meeting. Eventually, I met with Cllr Herron, but Cllrs Pringle and Isaacs did not attend. The meeting took place during the midday break of the Council meeting and I presumed there may have been a misunderstanding.
Cllr Herron said we should continue, and I gave him the background and history as I did with Cllrs Pringle and Isaacs previously. His response to me was that this was a historical case, done according to the manner/processes at the time and he did not think it warranted any further action. I enquired whether any action was required of me, and he replied in the negative.
I was left under the impression that he would raise it with Cllrs Pringle and Isaacs at the Council meeting which was in progress.

Thank you for the detailed explanation.
I’m afraid I don’t recall a discussion with Cllr Herron around this issue but perhaps Cllr Isaacs does. In any event, the request from Cllr Isaacs is for the City to obtain a legal opinion on the validity of the situation flowing from the following of past practices.

Just to clarify/ensure common understanding - in our discussions internally, our view was that the Subcouncil could request a legal opinion directly from legal services. In other words, it did not need to come via our (Human Settlements) offices. In that way it would be easier to define the brief directly with legal services, so they could provide their legal opinion directly the subcouncil.
We would then obviously provide the necessary inputs and support to that department.

Cllr Isaacs reported that they had a meeting with Mr van Niekerk on all human settlement motions and it was agreed to remove the items and pose questions to him whereby he would respond.
Goodman Rorwana added that it was also agreed to schedule a meeting with Ruby Gelderblom of Property Management, Andre van Nierkerk and to include the issue of the Chris Nissen Park.
Lwazi Nobaza wanted clarity on the motion.
The Chairperson responded that all the motions were withdrawn and will pose one single question and recommended that they send the motion to him and Andre van Niekerk so that they can engage on this matter together.
RESOLVED
That the motion be forwarded to Lwazi Nobaza of Human Settlements Department.
That the item be REMOVED and the Subcouncil arrange a meeting with Andre van Niekerk, Ruby Gelderblom, Cllr Isaacs & Ald Pringle regarding all the Human Settlement motions.
