UNANIMOUSLY RESOLVED to RECOMMEND that the lease of portions of Erven 115, 1822 and Rem Erf 1213 Vredehoek situated Off Upper Buitenkant Street , Vredehoek shown hatched and lettered ABCDEFGHJKLMNOPQRST on the sketch STC 2925v1 marked annexure A attached to the report, in extent approximately 1, 1262 hectares, to United Herzlia Schools, or their successors in title, BE APPROVED subject to inter alia the following conditions that: a)A tariff rental of R828.70 per annum excluding VAT calculated at the rate applicable at time of transaction be payable; b)The lease will endure for a period of ten years; c)The rental will be adjusted annually in terms of the rental tariff structure as approved by Council; d)The property be used for sporting purposes only, e)Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority; f)Subject to compliance with any other statutory requirements; g)No compensation will be payable for any improvement made to the property; h)All outstanding accounts with the City of Cape Town must be settled; i)No lease agreement will be concluded until such time that a valid Telkom wayleave is in place; j)The objection is not upheld. 21/05/18: Mr Kolia advised the report is at the Legal Department and will be tabled at the next Subcouncil meeting. Cllr Diamond requested that a report be tabled depicting the timelines of all advertised property applications within Subcouncil 16 jurisdiction. 20/04/18: Mr Kolia advised a report will be tabled at the next Subcouncil meeting. 19/03/18: Email from Raafiq d/d 6/03/18 -" I have been informed by our admin section that they intend to advertise on 18 March 2018" 19/02/18: Remains outstanding. 22/01/18: Email from Mr Raafiq Kolia, dated 19/1/18: “United Herzlia paid the advertising fees and their application was advertised on 1 December 2017, calling for alternative proposals in taking this matter forward. We received one objection letter which we will send to the school for their reply. No other proposals were submitted.” Remains outstanding. 20/11/17: Email from Raafiq Kolia d/d 6/11/17: I personally spoke to Jeremy Broom representing United Herzlia this morning and we clarified the outstanding concerns that he had. He gave an undertaking to pay our advertising fees in the course of next week, so that we can advertise and follow the public participation process in taking this matter forward. 16/10/17: Email from Raafiq Kolia d/d 9/10/17: The lease plan was updated and our office sent off a request to the United Herzlia School as to whether or not they want to lease the additional area. We are waiting on their response so that we can take this matter forward. 18/09/17: Remains outstanding. 16/08/17: Negotiation still ongoing with the neighbour. Proposed lease to the abutting neighbours. Remains outstanding. 19/06/17: It was noted that the application was advertised. Remains outstanding. 15/05/17: Remains outstanding. 19/04/17: Remains outstanding. 15/03/17: Remains outstanding. 14/02/16: Cllr Stuart Diamond recused himself from the meeting for the consideration of this item. Mr Saul Jacobs represented the Property Department. Comments during discussion: • the property is being used as a sporting facility and not for gardening purposes. • lease should continue on a month-to-month basis while other option are investigated. • best utilization of space – to be leased to a sport organisation. After discussion, Subcouncil 16 agreed as follows: UNANIMOUSLY RESOLVED that the proposed lease of City land being portion of Erf 1115 abutting Erf 1112 situated at 11 Ludlow Road, Vredehoek: Andreas Henri Diacon BE DEFERRED and that it be re-advertised to allow sport organisations the opportunity to submit lease applications. 16/01/17: Raafiq Kolia represented the Property Department. It was pointed out that the report incorrectly indicates Cllr Ramsay as the ward councillor instead of Cllr Golding. It was suggested that Cllr Golding conduct a site inspection and consult with the current tenants of neighbouring properties before a decision is taken. UNANIMOUSLY RESOLVED that this item BE DEFERRED to allow ward councillor Brandon Golding to conduct a site visit and to consult with the current tenants of neighbouring properties and the Parks Department.
