Resolution detail

Mr Gregory September briefed the meeting as to the report. An interview was granted for both the objector and applicant. The objector, Mr Geoff Underwood motivated the objection as per the report and also proposed that servitude be registered over the property. The applicant, Mr Tommy Brümmer motivated the application by way of a presentation. See Addendum C. The Subcouncil was informed that the applicant and objector had reached an agreement, which included a servitude as reflected in resolution b) hereunder. After discussion, Subcouncil 16 supported the recommendation as contained in the report. UNANIMOUSLY RESOLVED that: a) for the reasons as reflected in the report, the application for building line departures for Erf 1296 Green Point, 32 Chepstow Road, BE APPROVED in terms of section 15 of the Land Use Planning Ordinance, no. 15 of 1985; subject to conditions set out in annexure A attached to the report. b) condition 2.4 be amended as follows: An area of 4.5m x 4.5m in the north east corner on the first floor of the property (as shown on drawing number 201 of the report) shall not be used as habitable or outdoor patio, and a servitude to this effect shall be registered over the property in favour of the owner of Erf 1295 Green Point.
