RESOLVED that:

a. The application for the Removal of restrictive title deed condition II (B) (c) of title deed Deed T8188/1983, in respect to Erf 22746, Goodwood BE REFUSED in terms of Section 98 (c ) of the City of Cape Town Municipal Planning By-Law, 2015.

b. The application for the deletion of previous conditions of approval for Erf 22764, Goodwood that relates to the restrictive condition II (B) (c) of title deed Deed T8188/1983 BE REFUSED in terms of Section 98(b)(i) of the Municipal Planning By-Law, 2015.

c. The application for rezoning of Erf 22746, Goodwood from Single Residential (SR1) to General Business Zone (GB2), BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law, 2015;

d. The application for the following permanent departures in respect of Erf 22746, Goodwood BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law, 2015:

• 14 Parking bays in lieu of 20 parking bays on site;
• Parking within 10m of a public street;
• To allow more than one carriageway crossing per public street;
• To allow carriageway crossing of 19m in lieu of 8m; and
• To allow vehicles to reverse across the side walk.

REASONS FOR DECISION:
The MPT REFUSED the application for the reasons as set out in Planner’s report, except reasons 7.1.5 and 7.1.7, which are amended and added an additional reason 7.1.8:


7.1.5. The proposal at a residential density of 175du/ha is considered to be not in scale and out character with the immediate context.
7.1.7. The permanent departures applied for that primarily relate to on-site parking and access provision is not supported as it directly relates to a development proposal that is regarded as not compatible with built form.
7.1.8. The principle of the proposed land use on the site is accepted but the current proposed form and the negative impact on the surrounding area are not accepted.
