UNANIMOUSLY RESOLVED that:
a. The application for consolidation of Erven 7078, 7079 and 10536, Somerset West, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A
b. The application for rezoning of the consolidated properties from Agriculture to Subdivisional Area Overlay Zone for Single Residential Zone I (conventional housing, private road, refuse room and temporary package plant) and Open Space Zone 3 (private open space) purposes BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A
c. The application for subdivision of the consolidated properties into 30 single residential portions and 1 private open space portion, as reflected on plan no 5415/4 dd July 2022, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A
d. The application for a Consent Use for a Utility Service (Temporary Package Plant) on a Single Residential erf, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in attached Annexure A
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add a reason as follows:
6.10 That the consolidation of the 3 erven enables a rational development that will not have a negative impact on surrounding properties
Annexure A:
Amend 3rd bullet point in condition 4 as follows:
Maintenance of communal areas, including roads and infrastructure, including the package plant
Condition 27 must be renamed to be a ‘note’ as follows:
Note: That the City will not approve nor recommend any packaged treatment plant technology. The owner of the facility must satisfy himself that the implemented technology is capable of reliably producing a treated effluent that complies with all licence conditions imposed on the facility.
