Resolution details

UNANIMOUSLY RESOLVED that:

a. An administrative penalty of R 200 000.00 BE DETERMINED for the unauthorised land use in terms of Item 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 47441 Blue Downs.

b. An administrative penalty of R 100 000.00 BE DETERMINED for unauthorised building work in terms of Item 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 47441 Blue Downs

REASONS FOR DECISION

The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add reason 6.7 as follows:

6.7 Having considered the serious gravity of the contravention, the large extent and especially the flagrant disregard for the law, the MPT was unanimously of the view that a higher penalty would be more commensurate with the contravention.
